Terms & Conditions

Read the terms and conditions for using Cheap Deliveries. By using our services, you agree to comply with these terms. Please review them carefully before using our platform.

CheapDeliveries.net (“Platform”) is operated as a logistics coordination and bidding system designed to connect customers with independent delivery contractors through a dynamic pricing model, including but not limited to the “Price Crusher” system of Same Day Delivery Network.

By accessing or using the Platform, creating an account, or submitting a delivery request, you (“Customer” or “User”) agree to the following Terms:

1. Nature of the Platform

  • CheapDeliveries.net operates solely as a broker and marketplace connecting Customers with independent delivery contractors (“Drivers”) affiliated with, but not employed by, Same Day Delivery Network.
  • The Platform does not perform deliveries and does not employ Drivers on its own.
  • The Platform facilitates:
    • Posting of delivery requests
    • Contractor bidding and acceptance
    • Communication between Customers and Drivers

2. Price Crusher Bidding System

  • The Platform may utilize a dynamic pricing system (“Price Crusher”) where:
    • Delivery requests are offered to Drivers at an initial, adjusted, or privileged rate
    • Drivers may accept, reject, or compete for delivery opportunities
  • Pricing may increase, decrease, or be reassigned based on:
    • Time
    • Availability of Drivers
    • Distance and route conditions
  • The Customer acknowledges that:
    • Pricing is not fixed until a Driver accepts and the delivery is confirmed
    • Multiple Drivers may view or compete for the same request

3. No Guarantee of Service

  • Posting a delivery request does not guarantee:
    • Acceptance by a Driver
    • Completion of delivery
  • A delivery is only considered confirmed when:
    • A Driver accepts the request, and
    • The Customer affirms or proceeds with the delivery

4. Independent Contractors

  • All Drivers are independent contractors affiliated with Same Day Delivery Network.
  • Drivers are not employees, agents, or representatives of CheapDeliveries.net.
  • Drivers are solely responsible and liable for:
    • Pickup, transport, and delivery
    • Condition of goods
    • Compliance with applicable laws

5. Third-Party Lead Sources

  • Delivery opportunities may originate from:
    • CheapDeliveries.net
    • Partner platforms (including but not limited to CheapDelivery.net, Same Day Delivery Network, and future systems)
  • Distribution of delivery opportunities to Drivers does not establish:
    • Employment
    • Exclusive rights
    • Guaranteed work

6. Payment Terms

  • Customers agree to pay all charges associated with accepted deliveries.
  • Payment terms may include prepayment, partial payment, or payment upon completion.
  • Failure to pay may result in account suspension, denial of future service, and/or collection efforts.

7. Cancellations and Adjustments

  • Customers may cancel requests prior to Driver acceptance without penalty.
  • Once accepted by a Driver, cancellation may result in partial or full charges.
  • Failure to be available for pickup or delivery may be treated as a completed service.

8. Prohibited Use

Customers agree not to request delivery of:

  • Illegal items
  • Hazardous materials
  • Stolen goods
  • Any items in violation of local, state, or federal law

The Platform reserves the right to refuse, report, or remove any request.

9. Limitation of Liability

  • CheapDeliveries.net is not responsible for loss, theft, or damage; delivery delays or failures; or actions/omissions of Drivers.
  • All delivery-related risks are assumed by the Customer and the independent contractor performing the service.

10. Indemnification

You agree to indemnify and hold harmless CheapDeliveries.net, Same Day Delivery Network, and affiliated parties from any claims, damages, or liabilities arising from:

  • Your use of the Platform
  • Any delivery request
  • Violation of these Terms

11. Account Responsibility

  • Users must provide accurate information.
  • You are responsible for all activity under your account.
  • Unauthorized use must be reported immediately.

12. Consent to Communications

By creating an account or using the Platform, you expressly consent to receive communications from CheapDeliveries.net, Same Day Delivery Network, and its affiliates, including email, phone calls, text messages (SMS/MMS), and mailers.

These may include delivery updates, account notifications, promotional messages, and delivery postings.

You acknowledge that:

  • Messages may be sent using automated systems
  • Message/data rates may apply
  • You may opt out of promotional communications at any time

13. Suspension and Termination

CheapDeliveries.net reserves the right to suspend or terminate accounts, restrict access, and remove delivery requests at its sole discretion, with or without notice.

14. Modifications to Terms

These Terms may be updated at any time. Continued use of the Platform constitutes acceptance of any changes.

15. Governing Law

These Terms shall be governed by the laws of the State of California.

16. Electronic Agreement

By clicking “I Agree,” creating an account, or using the Platform, you acknowledge that:

  • You have read and understood these Terms
  • You agree to be legally bound by them

17. No Circumvention / No Going Around the Platform

a. Platform Protection

CheapDeliveries.net is a broker platform that invests resources in generating delivery opportunities and connecting Customers and Drivers. By using the Platform, you agree not to bypass or avoid the Platform in any transaction or relationship formed through it.

b. Prohibited Conduct

  • Conduct or attempt to conduct any delivery transaction outside of the Platform with any party first introduced through the Platform
  • Exchange contact information for the purpose of avoiding Platform fees or processes
  • Redirect, continue, or renew any business relationship formed through the Platform outside of the Platform
  • Solicit or accept future work outside of the Platform that originated from a Platform connection

c. Scope of Protection

This restriction applies to all relationships, communications, and opportunities arising from CheapDeliveries.net, Same Day Delivery Network, the Price Crusher bidding system, and any affiliated, partner, or future platforms operated by or connected to the Platform.

d. Time Restriction

This obligation applies during your use of the Platform and for 18 months following your last interaction with any party introduced through the Platform.

e. Presumed Violation

Any effort to take a relationship formed through the Platform and conduct business outside of the Platform shall be presumed a violation of this Agreement, regardless of intent.

f. Liquidated Damages

You agree that any violation of this section will result in liquidated damages equal to the greater of:

  • $1,000 per violation, or
  • The total value of the transaction(s) conducted outside the Platform, including any reasonably projected future transactions

g. Enforcement Rights

  • Suspend or permanently terminate accounts involved in circumvention
  • Recover damages, fees, and enforcement costs
  • Pursue legal action where necessary

h. Survival

This section shall survive termination of your account or use of the Platform.

18. Platform Fee Survival / Continuing Obligation

a. Continuation of Platform Fees

If a Customer and Driver introduced through the Platform engage in any transaction outside of the Platform, the Platform’s service fee shall still be owed to CheapDeliveries.net.

b. Scope

  • The original transaction
  • Any continuation of services
  • Any future or repeat transactions between the same parties

c. Fee Amount

The amount owed shall be the standard Platform fee that would have applied, or a reasonable fee determined by CheapDeliveries.net based on distance, rate, market conditions, and prior transaction history.

d. Payment Obligation

Both the Customer and Driver shall be jointly and severally responsible for payment of such fees.

e. Presumption of Applicability

Any transaction between parties previously connected through the Platform shall be presumed to have originated from the Platform unless proven otherwise.

f. Survival Period

This obligation remains in effect during use of the Platform and for 18 months following the last interaction facilitated by the Platform.

g. Independent of Circumvention Clause

This section applies whether or not a violation of the Non-Circumvention clause is formally proven.

20. Relationship Between Entities

CheapDeliveries.net is owned and operated by Same Day Delivery Network but functions as a separate platform and service offering.

Nothing in these Terms shall be construed to create:

  • An employer-employee relationship between CheapDeliveries.net and any Driver
  • A joint venture, partnership, or agency relationship between CheapDeliveries.net and Same Day Delivery Network
  • Any obligation for CheapDeliveries.net to perform delivery services directly

21. Customer Readiness, Wait Time, and Missed Pickup Policy

a. Customer Responsibility

  • Be present and available at the scheduled pickup location
  • Be ready to release item(s) for pickup at the agreed time
  • Be responsive to Driver communication regarding timing and location

b. Wait Time

A standard wait time of 10–15 minutes may apply unless otherwise stated.

c. Missed Pickup / Non-Ready Customer

  • Delivery may be treated as a failed pickup attempt
  • Customer may be charged a non-pickup fee or partial route fee
  • Driver may proceed without further obligation

d. Route Integrity

Customers acknowledge route optimization and may incur additional fees for disruption.

e. Driver Rights

  • Leave after reasonable wait time expires
  • Skip or re-sequence stops to maintain route efficiency
  • Report the delivery as delayed, failed, or customer-no-show

f. Fee Determination

Applicable fees will be determined based on distance impacted, time lost, route disruption, and Driver opportunity cost.

22. Connected Platforms, Shared Accounts, and Data Usage

CheapDeliveries.net, Same Day Delivery Network, and ScheduleADelivery.com are affiliated delivery and logistics platforms operated by the same ownership and/or related business entities.

By registering for or using any affiliated platform, the customer authorizes the Company to create, activate, link, or maintain corresponding accounts across affiliated platforms for service delivery, support, operations, compliance, and policy enforcement.

Account and transaction information may be shared among affiliated platforms and authorized personnel as reasonably necessary to provide services and manage accounts.

Use of any affiliated platform constitutes acceptance of this Agreement, the Privacy Policy, and any additional policies incorporated by reference.

Legal Entity Identification

CheapDeliveries.net, Same Day Delivery Network, and www.scheduleadelivery.com are owned and operated by Markei Enterprise., a California corporation. References to the “Company” include Markei Enterprise., its affiliates, subsidiaries, successors, assigns, employees, agents, contractors, and authorized representatives.

23. Billing & Collections Policy

1. Invoicing and Payment Terms

All services are invoiced upon completion or as otherwise agreed in writing and are subject to Net 15 payment terms.

2. Credit Limit

CheapDelivery.net may assign or enforce a maximum account credit limit of $700.00 in outstanding unpaid invoices per customer.

3. Suspension of Services

CheapDelivery.net reserves the right to suspend, delay, or refuse services if credit limits are exceeded or invoices are delinquent.

4. Late Payments and Collections

  • Suspension of service
  • Account hold or refusal of new orders
  • Referral to third-party collections
  • Recovery of collection costs and reasonable attorney’s fees where permitted by law

5. Reinstatement of Service

Services may be reinstated at CheapDelivery.net’s sole discretion once balances are paid in full.

6. No Waiver

Failure to enforce any portion of this policy at any time shall not constitute a waiver of future enforcement rights.
